These Terms of Use ("Terms") govern your access to and use of the Movari mobile application and related services (the "App" or "Service"), operated by Radical App Foundry ("Movari", "we", "us", or "our").
By creating an account, tapping "I agree to the Terms & Privacy Policy", or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
Movari is a fitness and wellness application that helps you:
Movari is designed to support general fitness and wellness and is not a medical service. The current release does not include buddy matching, community feeds, leaderboards, squads, direct messaging, or public social sharing.
You must:
We do not knowingly permit children under 13 to create accounts or use the Service.
To use most features, you must create an account using a valid email address and password.
You agree to:
Recommendations and calculations depend on information you provide, including age, sex, height, weight, goals, and activity levels. Providing inaccurate information may result in inaccurate recommendations or estimates.
You may permanently delete your account at any time through Profile → Settings → Delete Account.
What we delete from our active systems: When you delete your account, we promptly delete or irreversibly anonymise personal data stored in our active systems, including your account credentials, profile, workout and nutrition logs, progress data, photos you uploaded, and support communications linked to your account.
While your account is active: Meal photos linked to food logs older than 180 days are automatically removed from storage via a weekly cleanup. The food log entry (without the image) may be retained.
On deletion: Remaining personal data in our active systems is removed or irreversibly anonymised without undue delay.

Prices may change for future purchases. Changes will apply at renewal in accordance with applicable app store requirements.
Eligible users may receive a 7-day free trial. Unless cancelled before the trial ends, the subscription automatically converts into a paid subscription through the applicable app store. Trial eligibility is determined by Apple or Google.
Subscriptions are billed through the Apple App Store or Google Play. Payment processing, renewals, cancellations, and refunds are managed by the relevant app store. We do not receive or store your payment card details.
Subscription ownership: Movari Pro subscriptions are tied to your Apple ID or Google account, not your Movari account email. Deleting your Movari account does not automatically cancel a store subscription.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You may restore purchases through the App if reinstalling Movari or changing devices.
Except where required by law or applicable app store policy, Movari does not issue refunds directly. Refund requests must be submitted through Apple or Google.

You must not rely on Movari for emergency or life-critical decisions.
Movari uses third-party artificial intelligence services, including Google Gemini, to provide meal scanning, nutrition guidance, and meal planning features.
You acknowledge that:
Movari may integrate with Apple Health and Health Connect. If enabled by you:
Movari relies on third-party services including Firebase, RevenueCat, Google Gemini, Apple Health, Health Connect, Apple App Store, and Google Play.
Your use of those services may also be governed by their own terms and privacy policies. Movari is not responsible for third-party outages, policies, or practices outside our reasonable control.
The App, including its branding, software, design, text, graphics, and functionality, is owned by Radical App Foundry or its licensors.
You receive a limited, non-exclusive, non-transferable, revocable licence to use Movari for personal, non-commercial purposes. You may not reproduce, distribute, modify, sell, or exploit any part of the App without written permission.
Our collection and use of personal information are described in the Privacy Policy. By using Movari, you acknowledge and agree to those practices.
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. The Service may experience downtime, maintenance, or outages without prior notice.
We may update features, perform maintenance, modify functionality, discontinue parts of the Service, or offer experimental or beta features that may be unstable, inaccurate, or discontinued at any time without guarantee of availability, accuracy, or continued support.
We may suspend or terminate access if you violate these Terms or where required by law.
Upon termination:
You may stop using Movari and delete your account at any time (see Section 3.3).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVARI IS PROVIDED "AS IS" AND "AS AVAILABLE."
WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that:
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or gross negligence to the extent such exclusions are not permitted by applicable law.
You agree to indemnify and hold harmless Radical App Foundry and its personnel from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of Movari, your violation of these Terms, or your violation of applicable law or third-party rights.
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.
Mandatory rights: Nothing in these Terms limits any mandatory consumer protection rights you may have under applicable law (including in South Africa, the EU, or the UK). Where local law gives you rights that cannot be waived by contract, those rights prevail.
You agree to first contact us at movari.fitness@gmail.com or info@radicalappfoundry.co.za to attempt to resolve disputes informally.
If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of the Republic of South Africa, unless mandatory consumer protection laws in your country require otherwise.
If you downloaded Movari through the Apple App Store or Google Play:
We may update these Terms from time to time. When material changes are made, we will update the "Last updated" date and may provide notice within the App or by email.
Continued use of Movari after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the App and delete your account.
