Welcome to EduSnap AI ("EduSnap", "we", "our", "us"). These Terms & Conditions ("Terms") govern your access to and use of our mobile apps, websites, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to be bound by these Terms.
1. Eligibility & Accounts
- You must be capable of forming a binding contract in your jurisdiction. If you are a minor, you represent that you have parental/guardian consent where required by law (e.g., POPIA in South Africa).
- You are responsible for the security of your account credentials and for all activities under your account.
- Provide accurate information and keep it up to date.
2. Acceptable Use
- Do not attempt to access accounts or data that do not belong to you, interfere with the Service, or reverse‑engineer our software or AI systems.
- Do not upload content that is unlawful, infringing, or harmful, including content that violates privacy, intellectual property, or exam/assessment rules.
- Use generated content responsibly. Our AI outputs are educational aids and are not a substitute for official curriculum materials or teacher/assessor guidance.
3. Educational Content & AI Outputs
- AI‑generated questions, summaries, and guidance may contain errors or omissions. Always verify critical facts against authoritative sources.
- We do not guarantee improvements in academic performance.
- You may use AI outputs for personal, non‑commercial learning. Do not resell or redistribute content without permission.
4. Intellectual Property
- The Services and all associated software, designs, and content are owned by EduSnap or our licensors and are protected by applicable copyright and other laws.
- Subject to these Terms, we grant you a limited, revocable, non‑transferable license to use the Services for personal, non‑commercial purposes.
5. Subscriptions, Trials, & Billing
- Billing through app stores. Purchases and subscriptions are processed by Google Play / Apple App Store and managed by RevenueCat. Store terms and policies apply.
- Renewals & cancellation. Subscriptions renew automatically unless cancelled in the app store settings before the renewal date. Access continues until the end of the current period.
- Trials. If offered, trials convert to paid subscriptions unless cancelled before trial end.
- Refunds. Requests are handled by the respective app store per their policies.
- Entitlements. Features available to you (e.g., "Pro", "Elite") depend on your active subscription status.
6. User Content
- You retain ownership of content you upload (e.g., photos of pages, notes). By uploading, you grant us a non‑exclusive license to process that content to provide the Services to you.
- You represent you have the rights necessary to upload the content and that it does not infringe third‑party rights.
7. Privacy
Your use of the Services is subject to our Privacy Policy, which explains what we collect, why, and your choices (including in‑app deletion and request‑based deletion).
8. Termination
- You may stop using the Service at any time. You can delete your account in‑app or submit a request at our Data Deletion page.
- We may suspend or terminate access for violations of these Terms, suspected fraud/abuse, or to comply with law.
9. Disclaimers
- The Services and AI outputs are provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not warrant that the Services will be uninterrupted, error‑free, or that content will be accurate, complete, or suitable for your purposes.
10. Limitation of Liability
To the maximum extent permitted by law, EduSnap and its providers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Services.
11. Indemnity
You agree to defend, indemnify, and hold harmless EduSnap from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.
12. Changes to the Services or Terms
We may improve, modify, or discontinue features at any time. We may update these Terms as our Services evolve. Material changes will be communicated in‑app or on this page. Your continued use constitutes acceptance of the updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of South Africa (without regard to conflict‑of‑law principles), unless the law of your habitual residence requires otherwise. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of South Africa, unless applicable law permits otherwise.
